She tried making several other purchases as well but they were denied. I found out after one of the stored contacted me to ask if it was me that had placed these orders. I said No. After having this checked out, my bank sent me papers stating if I filed charges then they would reimburse me take action on her. Through our towns grapevine she found out I talked to a mutual friend said I would hold off if she was willing to pay me back the money she spent. So what I want to know is, what will take place now? Should her I write out some sort of contract with receipts if so will they hold up in court on her behalf as well as my own? Any links to websites would be appreciated as well as any advice. Im looking for templates online but haven’t found the right one to go with what Im looking for

    What you are looking for is a simple promissory note or IOU with her as payer and you as payee. However, since she has used your card illegally, I certainly wouldn’t trust her with a payment plan of any sort. Your best bet is to give her a set period of time (say 48 hours) to come up with the cash or you will file the report. If she hasn’t paid you in that time, follow through and protect yourself.

Well, First thing, if she still has any of these gift cards, she must return them immediately and have the credits applied back to your account. Give her no more than 24 hours to do this. IF she doesn’t, file charges, and that will put her butt in gear very quickly.

    Otherwise if your relationship with her is important, then have her sign a promissory note that is witnessed by a notary and give her no more than 2 months to pay it back. Make the payments weekly. The first time she misses one, off to the police you go.

    File immediately against the party. You should also put it on fraud alert through Trans Union Fraud Dept. Their toll free # 1-800-680-7289. They’ll notify the other 2 bureaus and must be renewed every 90 days in order to keep it active. Better to be safe now than sorry later.

    Call the card’s bank and tell them about the unauthorized charges. They will remove them and settle with the merchants. Forget the contract. Report the charges.
